1. Introduction
These Terms of Service ("Terms") govern your use of the Scorika API and related services ("Service") provided by Sinfin s.r.o. ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service Description
Scorika provides a fraud detection and risk scoring API that analyzes various data points (email, IP address, phone number, etc.) to generate risk scores and fraud signals.
The Service is provided "as is" and is intended to assist with fraud prevention decisions. The Service does not make final decisions — you are solely responsible for how you use the risk scores and signals.
3. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to reverse-engineer or extract the underlying algorithms
- Share API keys with unauthorized third parties
- Exceed your plan's rate limits or attempt to circumvent them
- Use the Service to discriminate against individuals based on protected characteristics
- Submit false or misleading data to manipulate results
- Resell or redistribute the Service without authorization
4. API Usage & Rate Limits
Your use of the API is subject to the rate limits and quotas defined by your subscription plan. Exceeding these limits may result in temporary suspension or overage charges as defined in your plan.
We reserve the right to suspend or terminate access for abuse, including but not limited to: excessive error rates, automated abuse, or violation of these Terms.
5. Data & Privacy
You are responsible for ensuring you have the right to submit data to the Service. We process data in accordance with our Privacy Policy.
Data retention periods vary by plan. See your plan details for specific retention policies.
6. Payment & Billing
Paid plans are billed according to the pricing displayed at the time of subscription. Prices may change with 30 days notice.
Subscriptions automatically renew unless cancelled. You will receive notification before each renewal as required by applicable law.
Refunds are provided at our discretion and only for unused portions of prepaid services.
7. Limitation of Liability ⚠️
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NO WARRANTY: The Service is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
- NO GUARANTEE OF ACCURACY: We do not guarantee the accuracy, completeness, or reliability of risk scores or signals. The Service is a decision-support tool, not a definitive fraud determination.
- EXCLUSION OF DAMAGES: In no event shall the Company, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers
- Any bugs, viruses, or similar issues transmitted through the Service
- Any errors, inaccuracies, or omissions in the risk scores or signals
- Decisions you make based on the Service output
- Any third-party actions or content
- MAXIMUM LIABILITY: Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
9. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to the Service will be revoked
- You remain responsible for any outstanding payments
- We will delete your data according to our data retention policy
- Provisions that by their nature should survive (including liability limitations) will remain in effect
10. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
11. Governing Law & Disputes
These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.
Any disputes shall be resolved by the competent courts in the Czech Republic. Before initiating legal proceedings, parties agree to attempt good-faith resolution through direct communication.
